CHADIZA MAN IN COURT FOR ASSAULTING BOY FOUND IN ADULTERY
A 22 year old man has appeared in the Chadiza Magistrate Court for assaulting an 18 year old boy.
Before Magistrate Fred Munsaka, was Thamison Phiri, of Lavu village in Chief Mlolo’s Chiefdom in Chadiza District who allegedly unlawfully wounded Azion Tembo, of the same area, contrary to section 232 subsection (a) Chapter 87 of the penal code of the laws of Zambia.
Particulars of the offence are that on 22 November this year, at around 20 hours, the accused allegedly beat Tembo after he found him in the bush committing adultery with his wife.
The court heard that the accused found his wife who he had been married to for the past eight months, committing adultery with Tembo and immediately, a fight ensued.
But according to Tembo, the accused did not find him in the act but acted on hearsay by some public members.
Phiri, who admitted the charge, said he deliberately beat him because the person he referred to as a boy, was having an affair with his wife.
Tembo had a cut on his forehead after he was allegedly stabbed with a knife and was also stabbed on his left arm and left ear.
He said his friend, John Phiri who tried to separate them but failed, took him to Chadiza District Hospital before going to report at Chanida police post.
Magistrate Munsaka has since called for more witnesses to the case despite admitting the charge, saying more facts needed to be established for a clear judgment to be passed.
