Dj Rox Demanding K1 Million From Sho’dol Beauty For Image Copyright

MEDIA Personality Chanda Kangwa popularly known as DJ Roxy has dragged Sho’dol Beauty Store Limited to court for using her pictures on advertisement without consent.
DJ Roxy is demanding payment of K1 million as damages for infringement of right to privacy and copyright of her images.

In a statement of claim filed in the Lusaka High Court, DJ Roxy also seeks punitive damages against Sho’dol for their actions of knowingly circulating, distributing and transmitting her images without consent.


And DJ Roxy also seeks an order that Sho’dol, its servants and agents should stop using her images and render an account of all monetary benefits derived from its infringement of her right by unlawfully using her images.
DJ Roxy wants an audit to be conducted by an Independent auditor to be appointed by the court.


She stated that being a media personality, she posted images of herself on her personal Facebook page, Instagram and other social media platforms which she personally controls and handles.


“From a date unknown to the plaintiff, it came to her attention and knowledge that the defendant had been using the plaintiff’s image on their website for what appeared to be a beauty product advertisement for commercial gain.
The plaintiff avers that the defendant has publicly displayed, transmitted and distributed the image for commercial use in their business without her consent and knowledge,” DJ Roxy said.


She said Sho’dol has therefore, infringed her right not to have copies of her images issued to the public by a third party for commercial purposes.


DJ Roxy said the defendant is in breach of the statutory duty owed to her under the Copyright and Performance Rights Act Chapter 406 of the Laws of Zambia.
She is therefore, demanding payment of K1 million as damages.
